1. Acceptance of Terms
By creating an account or using Docly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid plan subscribers.
2. Description of Service
Docly is an AI-assisted dental billing tool that suggests CDT codes based on treatment notes submitted by users. The Service is intended to assist — not replace — qualified dental billing professionals. All code suggestions must be reviewed and verified by a licensed billing specialist before claim submission.
3. AI-Generated Content Disclaimer
Docly uses artificial intelligence to generate CDT code suggestions. These suggestions are provided for informational and workflow assistance purposes only. You acknowledge and agree that:
- AI-generated code suggestions may contain errors, omissions, or inaccuracies.
- Docly does not guarantee that suggested codes will be accepted by any payer or insurance company.
- You are solely responsible for verifying all codes before submitting any claim.
- Docly is not a licensed billing service and does not provide medical, legal, or financial advice.
- Reliance on AI suggestions without independent verification is done at your own risk.
4. User Responsibilities
You agree that you will:
- Not submit any patient-identifying information (name, date of birth, SSN, insurance ID) into the Service.
- Use the Service only for lawful dental billing purposes.
- Not attempt to reverse-engineer, scrape, or misuse the Service.
- Keep your account credentials secure and notify us of any unauthorized use.
- Comply with all applicable HIPAA guidelines when using the Service.
5. HIPAA Notice
Docly is designed to be used with de-identified treatment notes only. Do not enter any Protected Health Information (PHI) as defined under HIPAA. Docly does not act as a HIPAA-covered entity or business associate and does not sign Business Associate Agreements (BAAs) at this time. Use of the Service with PHI is done at your own risk and in violation of these terms.
6. Subscription and Billing
Free accounts receive 10 code reviews at no charge. Paid plans are billed monthly through our payment processor. You may cancel at any time; cancellations take effect at the end of the current billing period. We reserve the right to modify pricing with 30 days' notice.
7. Limitation of Liability
To the fullest extent permitted by law, Docly and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to denied insurance claims, lost revenue, or billing errors. Our total liability to you shall not exceed the amount you paid for the Service in the three months preceding the claim.
8. Intellectual Property
All content, design, and functionality of Docly is owned by its operators. CDT codes are owned by the American Dental Association. You may not copy, reproduce, or redistribute any part of the Service without written permission.
9. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms. You may delete your account at any time from your account settings.
10. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
